THE CLAY TABLE MEMBERSHIP AGREEMENT

This Membership Agreement (“Agreement”) governs the Member’s studio membership and use of the Studio and incorporates, by reference, applicable Studio Policies and related documents.

1. Definition

“Studio” means The Clay Table ceramic studio, located at 19 Brookline Street, Cambridge, MA 02139, including all studio spaces, equipment, tools, kilns, and facilities operated by The Clay Table.

“The Clay Table” means the studio operator and business entity providing membership access, classes, and related services.

“Member” means any individual with an active studio membership in good standing, including Founding Members.

“Membership” means an active subscription or agreement that grants a Member access to the Studio in accordance with this Agreement and all applicable Studio Policies.

“Studio Policies” means all non-contractual rules, guidelines, procedures, notices, and policies governing use of the Studio, including but not limited to the Privacy Policy, Guidelines, Class Policy, posted signage, safety rules, and any updates published on the Studio website or posted within the Studio.

“Additional Fees” means fees charged in addition to regular membership dues, as described in the Section 10 (Additional Fees).

“Liability Waiver” means the separate Liability Waiver, Release, and Assumption of Risk required to be reviewed and signed prior to studio access, as referenced in this Agreement.

“Works” means any ceramic pieces, projects, or materials created, stored, or fired in the Studio.

2. Membership

2.1. Eligibility & Term

Membership is available only to individuals eighteen (18) years of age or older and is issued on an individual, personal, and non-transferable basis.

Memberships generally begin on the first (1st) day of each calendar month. In limited cases, and subject to Studio approval, a membership may begin on a date other than the first day of the month.

Memberships are offered on a month-to-month basis and will continue unless and until terminated in accordance with this Agreement.

Membership grants the Member a limited, revocable license to access and use the Studio in accordance with this Agreement and all applicable Studio Policies.

2.2. Membership Restrictions

Membership is valid only for the registered Member. Sharing membership access, benefits, or access fobs with any other individual is strictly prohibited.

Memberships may not be paused or suspended. Once activated, membership remains active and subject to billing unless and until terminated in accordance with this Agreement.

2.3. Fees & Billing

2.3.1. Membership Fees

Membership fees are disclosed to the Member during onboarding prior to payment method setup. By completing payment method setup, the Member authorizes the Studio to charge the disclosed membership fee on a recurring basis in accordance with this Agreement.

Membership fees are automatically charged to the payment method on file through Stripe on the first (1st) day of each month. If a membership begins on a date other than the first of the month, the initial fee will be prorated based on a thirty (30) day month and charged upon activation. All subsequent monthly fees will be charged on the first (1st) day of each month.

2.3.2. Accepted Payment Method

All membership fees and any applicable additional fees are payable by credit card only through Stripe. No other forms of payment, including debit cards, bank transfers, checks, cash, or alternative payment methods, are accepted.

2.3.3. Additional Fees Authorization

Additional fees, including when they may be incurred and how they are billed, are described in Section 10 (Additional Fees). By maintaining an active membership, the Member authorizes The Clay Table to charge any applicable additional fees to the payment method on file.

2.3.4. Payment Failure, Access Suspension, and No Refund

If a Member’s payment is declined, interrupted, or otherwise fails, The Clay Table may temporarily suspend the Member’s studio access, including access fob privileges, until payment issues are resolved.

Such suspension does not constitute termination of membership unless otherwise specified by the Studio.

Any period of temporary access suspension resulting from payment failure does not pause, extend, or entitle the Member to a refund or credit of membership fees.

2.3.5. Fee Changes

The Clay Table reserves the right to modify membership fees from time to time. Any changes will apply prospectively only and will be communicated to Members in advance through reasonable means.

2.4. Guest Policy

  • Guest access requires advance registration through the Studio’s designated process. Each Member may host one (1) guest per month, and each guest visit is limited to one (1) day.

  • Guests must comply with all Studio policies and must remain with their host Member while in the Studio at all times. The host Member assumes full responsibility for their guest’s conduct, safety, and compliance with Studio policies.

  • By registering a guest in advance through the Studio’s designated process, the Member acknowledges and agrees that they are solely responsible for their guest while on Studio premises.

2.5. Membership Termination Notice

Members who wish to terminate their membership must submit notice through the Studio’s designated termination process at least thirty (30) days prior to termination. Termination will take effect on the last calendar day of the applicable month, consistent with the Studio’s monthly billing cycle. Membership fees are billed in full monthly increments and are not subject to prorated or partial refund.

All access fobs must be returned upon membership termination. If an access fob is not returned, the replacement cost may be deducted from the member’s security deposit.

Any outstanding additional fees incurred during the membership period, including fees related to studio use or damages, may be charged upon termination. Additional fee policies and applicable charges are described in the Section 10 (Additional Fees).

If a Member’s payment is declined, interrupted, or otherwise fails, and the Member cannot be reached after reasonable attempts by the Studio, The Clay Table reserves the right to suspend or terminate the membership. In such cases, the membership deposit shall be forfeited and will not be refunded.

3. Studio Access & Use

3.1. Studio Access & Eligibility

Access to The Clay Table studio is granted to active members only and is subject to compliance with this Agreement, the Membership Agreement, the Liability Waiver, and all posted studio rules and policies.

The Clay Table reserves the right to limit, suspend, revoke, or terminate studio access or membership for any member who violates studio policies or engages in unsafe, negligent, or disruptive behavior, as determined by the Studio in its sole discretion.

The Clay Table reserves sole discretion in determining whether a violation has occurred.

3.2. Access Fob Use and Security

Members are responsible for helping maintain the safety and security of the studio community. Unauthorized access to the studio is strictly prohibited.

Members must not allow any individual to enter the premises without proper authorization. Members are not authorized to determine who is or is not a member and must not grant access to others under any circumstances, including by holding doors open, tailgating, or otherwise bypassing access controls.

Members are responsible for safeguarding their access fob at all times. Access fobs are issued for individual use only and may not be shared. If an access fob is lost, a fob replacement fee may be charged as an additional fee. Replacement fobs may require processing time and may not be immediately available.

Failure to follow access and security procedures may result in restricted studio access, additional security measures, or other actions at the discretion of The Clay Table.

4. Risk, Safety & Liability

All members are required to review, acknowledge, and sign The Clay Table Liability Waiver, Release, and Assumption of Risk prior to accessing or using the studio.

By accessing or using the studio, members agree to comply with all posted safety rules, instructions, and studio procedures.

The Liability Waiver is incorporated by reference into this Agreement. In the event of any inconsistency between this Agreement and the Liability Waiver, the terms of the Liability Waiver shall control to the fullest extent permitted by law.

5. Work, Materials, and Studio Resources

5.1. Work Storage, Abandoned Work, and Disposal

  • Studio storage space is limited and shared. Members must store work and materials only in designated areas and in accordance with posted guidelines.

  • All work placed in communal storage areas must be clearly and properly labeled based on its current stage. Unlabeled, improperly labeled, non-compliant, or unclaimed work may be moved, withheld from firing, relocated, discarded, or donated at the Studio’s discretion.

  • The Studio is not responsible for loss, damage, or disposal of work resulting from improper storage, labeling, or failure to follow procedures or retrieve work within required timeframes.

5.2. Clay Purchase, Usage Limits, and Production Restrictions

  • Members may purchase up to two (2) bags of clay per month. Unused clay purchases allowances do not roll over to subsequent months.

  • Members may produce work only in proportion to the amount of clay permitted per month. Storing or accumulating clay for future high-volume production beyond the monthly purchase limits is not permitted, regardless of how much clay a member has on hand.

  • All clay used in the Studio must be purchased through The Clay Table via the Studio website. Clay from external sources may not be brought into or used in the Studio.

  • Available clay types, pricing, and purchasing options may change from time to time and will be reflected on the Studio website.

  • Clay may not be sold, transferred, or traded between Members, including for the purpose of circumventing monthly purchase limits.

5.3. Glazing and Firing

  • Glaze raw materials and mixing chemicals are for authorized use only. Members may not access, handle, or mix these materials under any circumstances. Only trained and authorized studio managers may do so.

  • Members are responsible for properly glazing their work in accordance with studio guidelines.

  • Only studio managers are authorized to load kilns and fire work. Members are strictly prohibited from operating, loading, adjusting, or otherwise handling kilns under any circumstances.

  • The Clay Table reserves the right to delay, refuse, or decline firing any work that is deemed unsafe, improperly prepared, or not in compliance with studio guidelines.

  • If glaze runs onto kiln shelves, work requires additional kiln resources, or refiring is requested, applicable additional fees may apply in accordance with Section 10 (Additional Fees).

6. Damage to Facility or Equipment

Members will be held responsible for any damage to the facility or equipment if obvious negligence or improper use is the cause.

7. Property and Item Disposal

7.1. Discarded Items and Food Storage

  • The Clay Table reserves the right to discard unattended, expired, unsanitary, or perishable items, including food, left in shared spaces or the studio refrigerator, without prior notice for health, safety, or operational reasons.

  • The studio is not responsible for any items discarded under these circumstances.

7.2. Lost or Personal Property

The Clay Table is not responsible for the loss, theft, or damage of personal belongings brought into the Studio. Items left in designated areas for lost property will be held for thirty (30) days, after which they may be donated or discarded.

8. Communication & Reporting

Members must follow posted emergency and safety procedures and promptly report emergencies or safety concerns to studio management.

9. Policy Updates

The Clay Table reserves the right to update or revise this Agreement at any time for safety, operational, or management reasons.

Notice of significant changes will be provided by posting the updated Agreement on the Studio website and the Studio bulletin board.

It is each member’s responsibility to review and stay informed of the most current version of this Agreement.

Continued use of the studio after such updates constitutes acceptance of the revised Agreement.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.

11. Additional Fees

Additional fees may apply under certain circumstances. The Clay Table reserves the right to assess additional fees as reasonably necessary for studio operations. Current and updated fee amounts will be posted on the Studio bulletin board.

Additional fees may include, but are not limited to:

  • Access fob replacement fees, including lost or unreturned access fobs

  • Oversized work fee:
    Fees related to oversized or unusually large work that requires extra kiln space, special handling, or additional firing resources. Fee amounts are determined based on the size, complexity, and firing requirements of the work.

  • Glaze running fee:
    Fees related to glaze running or glaze damage, including glaze that runs onto kiln shelves or otherwise causes damage

  • Glaze refiring fee:
    Fees related to glaze refiring, including approved refiring requests that require additional kiln use, labor, or handling

  • Fees related to damage to studio facilities, equipment, or property, including the cost of repair or replacement, resulting from negligence, misuse, or failure to follow posted procedures or instructions

Applicable fees may be automatically charged to the payment method on file through Stripe, either at the time they are incurred or together with the member’s next scheduled membership payment, unless otherwise specified.

At a member’s request, the Studio may also process payment for clay, tools, or other physical goods on the member’s behalf, which may be charged to the payment method on file through Stripe.

Acceptance of of This Agreement

By accessing or using The Clay Table studio, members acknowledge that they have read, understood, and agree to be bound by this Agreement.
